A. Agreement
i.
In consideration for the timely and prompt payment of the Fees specified herein, Kama’aina Kids shall allow RENTER to use the Banquet Hall (as defined below) on the Date of Event between the Entry Time and Exit Time specified above, all in accordance with the terms and conditions set forth herein.
B. Fees
i. Rental Fees
Rental fees for use of the Banquet Hall at Kama‘aina Kids at St. John the Baptist Episcopal Church (hereafter referred to as the “Banquet Hall”) follow and are based on the charges set forth in the RENTAL AGREEMENT. Rental fees are due 30 days prior to the Date of Event (hereinafter the “Reservation Date”). The Rental Fee covers a maximum capacity of 300 people. Additional charges applying should RENTER exceed the maximum capacity.
ii. Security Deposit
A Security Deposit shall be paid to secure the requested Date of Event and full and faithful performance of all terms and conditions contained in the RENTAL AGREEMENT. If all conditions of the CLEANING GUIDELINES (attached) are met, the Security Deposit will be refunded. All violations will be deducted as listed in DEPOSIT DEDUCTIONS (attached). The RENTER is informed and understands that the processing period for any refund of Security Deposit requires a period of up to 2 weeks.
iii. Service Fees
Canceled/returned checks are assessed a $100 fee and late payments shall be assessed a $20 fee.
iv. Overtime Fee
If the RENTER unexpectedly runs past the agreed end time at the conclusion of RENTER’s Event, the RENTER will be assessed an overtime fee of $25 per 15 minutes or a fraction thereof incurred against the Security Deposit.
C. Use
i. Unlawful Uses are Strictly Prohibited
RENTER may only use the Banquet Hall for lawful purposes and shall be particularly mindful of and strictly adhere to any statutes, ordinances or other rules pertaining to noise, parking, alcohol consumption or the use or possession of illegal drugs.
ii. Use Must be Compatible with the Location
The Banquet Hall is located in a residential area on the grounds of St. John the Baptist Episcopal Church. Uses that are incompatible with the location or character of the property are strictly prohibited. This would include uses that are contrary to, or incompatible with, the teachings and doctrine of the Episcopal Church.
D. Confirmation
Reservation Date is confirmed upon receipt by Kama‘aina Kids of Security Deposit (see page 4) AND the signing of the RENTAL AGREEMENT. If more than one party is interested in a specific date, reservations will be done on a “first come, first served” basis. Payment shall be made by check, money order, debit/credit card. Checks should be made payable to Kama‘aina Kids. There will be a $100 charge for any check that is returned due to insufficient funds
E. Cancellation
Kama‘aina Kids will refund all FEES (except Service Fees), for any cancellations made 90 days before the Reservation Date. Cancellation made less than 90 days of the Reservation Date must be made in writing. Cancellations made 30 days or less of Reservation Date are subject to additional charges at the discretion of Kama‘aina Kids based on seasonal usage and inability to secure another RENTER.
F. Excused Non-Performance
If, for any reason beyond its control, including but not limited to accidents, acts of war, or acts of God, Kama‘aina Kids is unable to perform its obligations under this Agreement, such non-performance is excused and Kama‘aina Kids may terminate this Agreement without liability of any nature upon return of RENTER’s fees and deposit. Kama‘aina Kids will not be liable for consequential damages of any nature, under any circumstances, for any reason, whatsoever.
G. Admissions Charges
Persons attending the Event contemplate herein will / will not be paying an admission for this Event.

H. Alcoholic Beverages
The use or possession of alcohol shall be confined to the PREMISES and shall be in accordance with all applicable State and City & County ordinances, rules and regulations. If alcohol is sold at the Event, a temporary Liquor Permit is required and must be presented at any time during the Event.
I. Indemnity
The RENTER shall indemnify, defend, and hold harmless Kama‘aina Kids, Kama‘aina Kids at St. John the Baptist, St. John the Baptist Episcopal Church, and The Episcopal Church in Hawai‘i, against suits, damages, settlements, and awards arising in connection with or attributable to the use of the premises by the RENTER and/or its guests, invitees, agents, or assignees. This indemnification shall, among other things, include indemnification against any and all actions, proceedings, attorney’s fees, costs demands and any damages.
J. Insurance
RENTER must provide a Certificate of Insurance in a form acceptable to Kama‘aina Kids that confirms coverage for accidents, bodily injury and property damage occurring on the premises, or as result of the Event, in a minimum amount of $1,000,000 per occurrence. The Certificate of Insurance must name Kama‘aina Kids, Kama‘aina Kids at St. John the Baptist, St. John the Baptist Episcopal Church and The Episcopal Church in Hawai‘i as additional insureds. If alcohol is served or consumed at the Event, the Certificate of Insurance must also confirm coverage for liquor liability and social host liability.
K. Rubbish/Garbage Removal/Recycling
The RENTER shall be responsible for the removal of all rubbish/garbage from the premises and surrounding parking lot area immediately following the Event. All rubbish/garbage should be discharged into designated dumpsters on the premises. A charge of $100 shall be assessed if Kama‘aina Kids staff must remove rubbish/garbage. Kama‘aina Kids will deduct this charge from the security deposit. Recycling bins will be provided for items that meet the current state recycling codes. See also CLEANING GUIDELINES for other applicable guidelines.
L. General Clean-Up
The RENTER shall be responsible for sweeping and mopping the floors in the Banquet Hall, bathrooms and kitchen, immediately following the Event. Toilets & bathroom sinks must also be cleaned. Kama‘aina Kids shall provide cleaning supplies and equipment. The tables and chairs also need to be cleaned and put away in the proper storage area, and the kitchen counters, sink, and stove should be wiped down and free from any food or liquid. A charge of $100 shall be assessed if Kama‘aina Kids staff must perform any or all of these tasks. Kama‘aina Kids will deduct this charge from the Security Deposit. M. The Grounds
The RENTER shall be responsible for any damages to the surrounding flora. There is NO CUTTING of any surrounding flora found within the grounds for personal decorations or usage. Damages to be assessed and levied against the Security Deposit.
N. Set-Up/Decorations
Glitter and/or throwing confetti or rice is not allowed. Decorations may not be nailed, stapled, or tacked to any part of the facility. If decorations need to be mounted on the walls, use of white putty tack or tape is allowed. Decorations must be removed immediately following RENTER’s Event, and must comply with governmental laws, rules, regulations and ordinances, including but not limited to, fire code regulations. No decorations will be allowed on the outside of the Banquet Hall except for balloons and streamers. No signs will be allowed on the outside of the Banquet Hall except at the entrance doorway.
O. Security
Security is mandatory when renting Banquet Hall for any and all functions. The RENTER can reserve security through Kama‘aina Kids at St. John the Baptist Episcopal Church when renting. Hawai‘i Security Services will provide security for up to 5 hours which is included in the Rental Fee with any additional time needed provided at a cost of $37 per hour after the 5 hours.

P. Smoking
Smoking is not permitted within any of the buildings at the Banquet Hall or within the restrooms located on property. In accordance with State law, smoking will only be allowed in the designated smoking area outside of the building. Any smoking done inside the building will result in the forfeiture of the security deposit.
Q. Discrimination Policy
The use of the Banquet Hall shall not be in support of any policy which discriminates against anyone based on race, creed, color, gender, religion, national origin, sexual orientation or physical handicap.
R. Conduct
Kama‘aina Kids reserves the right to terminate any Event under the following circumstances:
i. The Event is not properly chaperoned.
ii. The conduct of the guests attending the Event presents a threat to the health and safety of the individuals, or could damage the Banquet Hall Facility or surrounding properties.
iii. Rules and regulations are not complied with.
S. Exculpation of Kama‘aina Kids, Kama‘aina Kids at St. John the Baptist, St. John the Baptist Episcopal Church, & The
Episcopal Church in Hawai‘i, Waiver and Release of Claims
Kama‘aina Kids, Kama‘aina Kids at St. John the Baptist, St. John the Baptist Episcopal Church, and The Episcopal Church in Hawai‘i shall not be liable to the RENTER for any damage to the RENTER or RENTER property or RENTER’s guest(s) from any cause. The RENTER waives and releases all claims against Kama‘aina Kids, Kama‘aina Kids at St. John the Baptist, St. John the Baptist Episcopal Church and The Episcopal Church for damage to person or property arising for any reason.
T. Default
In the event of any default by the RENTER of any of the terms herein, the Event may be immediately canceled and RENTER shall be liable for all damages, including attorney’s fees and costs, which may be incurred as a result of said default, and steps taken to address said fault.
The undersigned has fully read and agrees to the Terms and Conditions of the RENTAL AGREEMENT and hereby confirms payment of Security Deposit in the amount of $__________ to Kama‘aina Kids for the engagement and usage of the Banquet Hall. The RENTER agrees to pay $____________ Rental Fee 30 days prior to the Date of Event (______________________). Failure to submit payment by this date will result in forfeiture of the Security Deposit and the termination of this agreement.
The RENTER hereby agrees to and assumes full and all responsibilities and liabilities for any damages, destruction, and/or losses incurred by Kama‘aina Kids during or as a result of the RENTER’s engagement and usage of the Banquet Hall. The RENTER also agrees that Kama‘aina Kids may assess charges to the RENTER for any damage, destruction or loss to the Banquet Hall property as a result of RENTER’s usage of the Banquet Hall.

Two forms of rentals are available. First is the basic rental with includes the use of the hall, the kitchen area for prep work and two refrigerators. The second rental includes the use of the kitchen for cooking and for use of the chafing dishes, utensils and other wares used to support the food service.

- Cleaning of bathrooms (counter, sinks, toilets and urinals).
- Cleaning of kitchen (counter, sinks and refrigerators).
- Breakdown and removal of tables and chairs.
Basic Cleaning Includes:
- Cleaning of floors (sweep and mop) in banquet hall, kitchen and bathrooms.
- Cleaning of bathrooms (counter, sinks, toilets and urinals).
- Cleaning of kitchen (counter, sinks and refrigerators).
- Breakdown and removal of tables and chairs.
Any other damages to the Banquet Hall (including rented equipment), Grounds (including plants and trees) or to the properties of Kama‘aina Kids will be assessed an appropriate fee.
I have read and understood the above responsibilities.
The Banquet Hall representative will provide an orientation of the facilities and discuss the checklist with the RENTER or designated representative(s). The Banquet Hall designated representative will check with the RENTER or the designated representative(s) as to the closing time; making sure the RENTER or the designated representative(s) knows where the cleaning supplies are, location of light/fan switches and that the RENTER or the designated representative(s) know that it will take at least one and one half hours (1.5) to accomplish all the cleaning prior to scheduled closing time.
